FENCE RULES – ELKO (CITY), NEVADA

GOVERNANCE
The City of Elko regulates residential fences through the Elko City Code and related department guidance.
The City does publish a dedicated fence, wall, and retaining-wall appendix, but standard residential fence rules are not contained in a single residential-only chapter. Relevant rules appear across Title 2, Chapter 2, Appendix Q, Title 2, Chapter 1, and Title 3, Chapter 2.
The City of Elko Building Department administers building permits, inspections, and building-code review. The Planning/Zoning Department administers zoning and development regulations. The Development Department coordinates development review, building-plan review, utility-department review, subdivision and parcel-map review, zoning assistance, and code-enforcement activities.
Code Enforcement handles municipal-code enforcement, including property maintenance, zoning violations, nuisance issues, and other code-compliance complaints.
PERMIT AND APPROVAL REQUIREMENTS
• Building Permit – Standard Fence Height: A building permit is not required for a standard fence when the overall height of the fence, including decorative trim and all components, does not exceed 6 feet 6 inches (6’6″) at any point and the fence does not rest upon a retaining wall.
• Building Permit Required – Wood, Vinyl, Chain Link, and Similar Materials: A building permit is required for fences over 6 feet 6 inches (6’6″) tall constructed of wood, vinyl, chain link, or similar materials.
• Building Permit Required – Block, Brick, Stone, Rock, or Similar Materials: A building permit is required for fences 4 feet (4′) or higher, measured from the bottom of the footing to the top of the fence, when constructed of block, brick, stone, rock, or similar materials.
• Building Permit Required – Fence on Retaining Wall: A building permit is required for any fence supported by a retaining wall when the overall height is 6 feet 6 inches (6’6″) or higher, measured from the bottom of the retaining wall footing to the top of the fence.
• Separate Permit by Parcel: When a fence, wall, or retaining-wall permit is required, a separate permit is required for each parcel where the fence, wall, or retaining wall is located, except for certain subdivision-related fence, wall, or retaining-wall work along property lines.
• Permit Application Information: A permit application for a fence, wall, or retaining wall must identify the property owner, material, total length, height, square footage, authorized construction agent, and a dimensioned drawing showing the location in relation to lot lines, easements, streets, rights-of-way, existing construction, and drainage features.
• Planning and Zoning Contact Triggers: City guidance directs property owners to contact the City of Elko Planning Department when building a fence in front of the home or on a corner lot.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Planning/Zoning Department before construction.
FENCE PLACEMENT RULES
• Property Lines and Setbacks: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
• Right-of-Way: No fence, wall, or retaining wall may be placed within a right-of-way unless permission is granted by City of Elko.
• Easements and Site Drawing: If a permit is required, the permit drawing must show the fence location in relation to lot lines, easements, streets, and other rights-of-way.
• Drainage: A permit will not be issued for a fence, wall, or retaining wall that would block any natural flow path.
• Front Yard and Corner Lot Review: City guidance directs property owners to contact the City of Elko Planning Department before building a fence in front of the home or on a corner lot.
• Gate Swing and Alley Rules: The code does not specify a gate-swing standard or alley-specific setback rule for standard residential fences.
• Utility Safety: Nevada law requires underground utility notification through Nevada 811 before excavation. For fence projects that involve digging, including fence post holes, notice must be provided before excavation begins.
FENCE HEIGHT AND VISIBILITY RULES
• Maximum Height: The code does not specify a maximum height for standard residential fences independent of building-permit thresholds and zoning compliance review.
• Standard Fence Permit Threshold: For wood, vinyl, chain link, and similar fences that do not rest upon a retaining wall, the controlling building-permit threshold is over 6 feet 6 inches (6’6″).
• Masonry-Style Fence Permit Threshold: For block, brick, stone, rock, or similar fences, the building-permit threshold is 4 feet (4′) or higher, measured from the bottom of the footing to the top of the fence.
• Retaining-Wall-Supported Fence Threshold: For a fence supported by a retaining wall, the building-permit threshold is 6 feet 6 inches (6’6″) or higher, measured from the bottom of the retaining wall footing to the top of the fence.
• Street-Intersection Visibility: In residential districts, no fence, wall, tree, shrub, or hedge may obstruct vision at street intersections.
• Sight-Triangle Dimension: The code does not publish a separate numeric residential sight-triangle dimension for fences.
MATERIAL AND CONSTRUCTION LIMITS
• Fence Materials Identified by Code: The Building Code defines a fence as a structure made of materials such as wrought iron, wire, wood, screen, vinyl, plastic, or similar materials, erected for enclosure, division of property, or decoration.
• Direct Safety Hazards Prohibited: Walls, fences, and retaining walls may not contain exposed materials that impose a direct safety hazard, including pointed posts, stakes, pickets, components intended for electrocution, embedded glass, nails, barbed or razor type wire, or other sharp or cutting objects.
• Barbed or Razor Wire Exception: Manufactured barbed or razor wire may be used only when its detailed use, location, and construction requirements are approved by City of Elko.
• Electrical Current: The zoning ordinance separately prohibits fences and walls containing electrical current or a charge of electricity.
• Fence Specifications: Specifications for fences and walls do not need to be submitted unless required by City of Elko.
• Retaining Walls: Drawings and specifications required for retaining walls must be prepared by a registered design professional. This retaining-wall requirement is separate from ordinary fence specifications unless the fence is supported by or combined with a retaining wall.
• Finished Side, Opacity, and Decorative Standards: The code does not specify a finished-side orientation, opacity requirement, or decorative standard for standard single-family residential fences.
PRIVATE RESTRICTIONS
Private restrictions operate independently from City of Elko fence rules.
HOA covenants, recorded declarations, deed restrictions, private development standards, planned community documents, and similar private agreements may be more restrictive than City rules. A City permit, permit exemption, or zoning clearance does not remove private restrictions that apply to the property.

• Right-of-Way and Easement Context: Review may address fence location in relation to rights-of-way and easements. No fence, wall, or retaining wall may be placed in a right-of-way unless City permission is granted.
• Drainage: Permit review addresses whether a fence, wall, or retaining wall would block a natural flow path.
• Visibility: Residential district review may address fences, walls, trees, shrubs, or hedges that obstruct vision at street intersections.
• Materials: Review may address direct safety hazards, including electrocution components, embedded glass, nails, barbed or razor wire, and other sharp or cutting materials.
