FENCE RULES – CABOT (CITY), ARKANSAS

OVERVIEW

Residential fences are permitted on private property within City of Cabot, subject to local regulations. For properties located outside City of Cabot municipal limits, Lonoke County regulates fences in unincorporated areas.

GOVERNANCE

Governing Authority: Residential fence rules are administered under the City of Cabot code framework, including the Unified Development Code, the Buildings and Building Regulations chapter, the Animal chapter, and the Flood Damage Prevention chapter.

Planning & Zoning: Planning & Zoning reviews development permit applications for compliance with Cabot development standards and the City Code. The department also handles building-permit and business-license review, zoning-related development permits, variances, plats, lot actions, right-of-way closures, and rezoning processes.

Administrative Official and Building Inspector: The Administrative Official administers the Unified Development Code, and the Building Inspector administers building-permit functions where a building permit is required.

No Consolidated Fence Code: The City of Cabot does not publish a single consolidated residential fence ordinance. Residential fence rules are distributed across zoning, visibility, animal-control, floodplain, and building-code provisions.

PERMIT AND APPROVAL REQUIREMENTS

Ordinary Residential Fence Permit: The visible City of Cabot Permit Applications materials do not list a standalone permit application for ordinary residential fences.

Building Permit Baseline: Because City of Cabot administers building permits and has adopted the 2021 Arkansas Fire Prevention Code, Volumes I, II, and III, the Arkansas statewide building-code baseline applies where local materials are silent on a stricter fence-permit rule: a building permit is required for a standard residential fence over 7 feet in height. This building-permit baseline does not override the City of Cabot zoning limits for residential fence, hedge, or wall locations.

Zoning and Location Compliance: Even where no standalone fence permit is listed, residential fences must comply with the Unified Development Code height, yard, and corner-visibility standards administered through Planning & Zoning.

Electronic Dog Fences: An electronic dog fence requires an exemption application filed with the Office of Animal Control. The application must include a site plan, property-line information, existing structures, proof that the animal is spayed or neutered, and evidence that the dog will not come within 10 feet of public footpaths, walkways, alleys, or streets and that the electronic fence will not be closer than 5 feet to adjacent property. The property must be posted for 10 consecutive days after filing, and the Office of Animal Control approves or denies a completed application within 30 days.

Floodplain Development: A fence project in a special flood hazard area may require a floodplain development permit when it includes structural development, clearing, grading, placement of fill, excavating, drainage improvements, watercourse alteration, or other development covered by the Flood Damage Prevention Code. The Mayor or the Mayor’s designee serves as floodplain administrator.

Swimming Pools: The Residential Permits page lists swimming pools among common residential permit items. The local materials reviewed do not publish a separate City of Cabot private residential pool-barrier fence standard.

FENCE PLACEMENT RULES

Required Front Yard: A residential fence, hedge, or wall not exceeding 4 feet may project into or enclose any required front yard.

Side Yard Behind Main Structure: A residential fence, hedge, or wall not exceeding 6 feet may project into the side yard from the rear of the main structure to the rear property line.

Rear Yard: The code does not specify a separate rear-yard fence height standard for ordinary residential fences.

Corner Lots: A fence on a corner lot must not obstruct intersection visibility under Unified Development Code Section 4.9.11.

Property Lines, Rights-of-Way, and Easements: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Electronic Dog Fence Placement: An approved electronic dog fence must be installed so the confined dog does not come within 10 feet of public footpaths, walkways, alleys, or streets, and the fence must not be installed closer than 5 feet from adjacent property.

Fowl Enclosures: Chicken and fowl enclosures are not allowed in the front yard of a residence. For this rule, the front yard is the area forward of the front corners of the primary residential dwelling.

Livestock Enclosures: Horses and cows may be kept only in an enclosed pasture containing at least 1 acre per horse or cow. Livestock may not run at large within the corporate city limits.

Utility Safety: Arkansas law requires notice through Arkansas 811 before excavation where the Arkansas Underground Facilities Damage Prevention Act applies. For fence projects that involve digging, including fence post holes, notice may be required before excavation begins. Arkansas law also includes specific exemptions, including certain agricultural-purpose posthole digging on private property outside an operator right-of-way.

FENCE HEIGHT AND VISIBILITY RULES

Front-Yard Height: A residential fence, hedge, or wall may not exceed 4 feet where it projects into or encloses a required front yard.

Side-Yard Height Behind Principal Structure: A residential fence, hedge, or wall may not exceed 6 feet where it projects into the side yard from the rear of the main structure to the rear property line.

Rear-Yard Height: The code does not specify a separate maximum height for ordinary residential fences in the rear yard.

Corner-Visibility Area: On a corner lot where a front yard is required, nothing may be erected, placed, planted, or allowed to grow in a way that materially impedes vision between 2.5 feet and 10 feet above the centerline grade of the intersecting streets within the area formed by the street right-of-way lines and a line joining points on those right-of-way lines 25 feet from the point of intersection.

Zoning Versus Building Permit Threshold: The Arkansas building-code permit baseline for standard residential fences over 7 feet is a permit trigger; it does not create local zoning permission to exceed the City of Cabot’s residential fence, hedge, or wall height limits.

MATERIAL AND CONSTRUCTION LIMITS

Ordinary Residential Materials: The residential fence section does not specify permitted materials for ordinary single-family residential fences, hedges, or walls.

Barbed Wire and Razor Wire: The code discusses barbed and razor wire in commercial and industrial fence contexts. The residential fence section does not publish a barbed-wire or razor-wire standard for ordinary single-family residential fences.

Finished Side and Opacity: The code does not specify a finished-side orientation, opacity requirement, or decorative standard for ordinary single-family residential fences.

Animal-Control Fence Definition: For animal-control purposes, a fence is a physical barrier constructed to provide a barrier between an animal and the public. That animal-control fence definition states that fencing must not be made of material that requires electricity or batteries to operate.

Electronic Dog Fences: Electronic dog fences are handled as an exemption process through the Office of Animal Control, not as an ordinary physical fence material standard.

Potentially Dangerous Breed Dogs: A potentially dangerous breed dog may not be confined by an electronic containment device or invisible fence. When confined outdoors, the dog must be confined by a fence of adequate height and construction to prevent escape or be restrained as required by the animal-control rules.

Vicious Dog Enclosures: A vicious dog kept outdoors and unattended must be kept in a secured enclosure with a covered or secured top and a secured bottom.

Beehive Protection: Active beehives must be placed within a protective fence or other enclosure that prevents tampering or ingress of passersby.

PRIVATE RESTRICTIONS

Private Rules: HOAs, subdivision covenants, deed restrictions, private easements, agricultural agreements, architectural-review covenants, and private boundary agreements operate independently from City of Cabot requirements and may be more restrictive.

Private Enforcement: The City of Cabot materials do not state that the City enforces private fence covenants or private boundary agreements as municipal fence rules.

Animal Restrictions: The fowl rules state that homeowners’ associations, property owners’ associations, and similar organizations may prohibit chickens within the bounds of their authority.

Corner-Lot Visibility: Fences, walls, hedges, landscaping, or other obstructions may be reviewed where they materially impede visibility between 2.5 feet and 10 feet within the 25-foot right-of-way visibility area at an intersection.

Electronic Dog Fence Review: Electronic dog fence exemptions are reviewed by the Office of Animal Control, including the 10-foot public-way separation, 5-foot adjacent-property separation, spay/neuter proof, site-plan information, property posting, and effective containment requirements.

Animal-Control Review: Fences or enclosures used for potentially dangerous breed dogs, vicious dogs, livestock, chickens, fowl, or beehives may be reviewed under the animal-control rules that apply to those specific animals or uses.

Floodplain Review: Fence-related work in a special flood hazard area may be reviewed by the floodplain administrator when the work includes development activity covered by the Flood Damage Prevention Code.
