FENCE RULES – NORFOLK (CITY), NEBRASKA

GOVERNANCE

The City of Norfolk regulates residential fences through the Norfolk City Code and administers fence-related permitting through Planning & Development, Building Services.

The principal fence section is Sec. 27-288, which covers residential fence height, materials, orientation, easements, and maintenance. Sec. 27-290 controls sight-triangle visibility restrictions. Sec. 14-227 separately addresses barbed wire and electric fences.

The city does not publish a separate consolidated residential fence code apart from these code sections and Building Services information sheets. Relevant administration is handled through Planning & Development, Building Services, and code compliance staff within the Planning and Development structure.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit and Inspection: A Building Permit and inspection are required for fences over 4 feet high.

Fences 4 Feet or Less: Fences 4 feet or less in height are listed by Building Services as residential projects that do not require a permit.

Permit Threshold Controls: The City of Norfolk publishes a stricter local fence permit threshold than the Nebraska statewide baseline. The local rule controls: fences over 4 feet high require permit and inspection.

Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Planning & Development before construction.

Floodplain, Historic, or Overlay Approval: The code materials reviewed for this residential fence page do not specify a fence-specific floodplain, historic, or overlay approval requirement for standard single-family residential fences.

FENCE PLACEMENT RULES

Required Yards: Residential fences are allowed in required front, street-side corner, rear, and interior side yards, subject to the height and visibility limits in Sec. 27-288 and Sec. 27-290.

Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Sight Triangle Areas: On corner lots, fence placement within the required visual clearance area is subject to the sight-triangle restrictions in Sec. 27-290.

Drainage Easements: Fence construction within utility easements, natural drainage easements, or drainage easements must avoid limiting or obstructing the flow of water in natural drainage courses or drainageways created within easements.

Utility Easements: Fences on land subject to easements for water, sanitary sewer, storm sewer, gas, electric power, telephone, utility poles, cables, or lines must be designed and constructed to be readily accessible or removable to permit use of the easement.

Removal Cost in Easements: If a fence is not constructed to allow easement access, the cost of removal or replacement is the responsibility of the fence owner.

Utility Safety: Nebraska law requires notice through Nebraska 811 before excavation begins. For fence projects that involve digging, including fence post holes, notice generally must be given at least 2 full business days and not more than 10 business days before excavation begins, subject to limited exceptions.

FENCE HEIGHT AND VISIBILITY RULES

Front Yard Height: Required front-yard fencing between the front building wall line and the street is limited to 4 feet high.

Street Side Corner Height: Required street-side corner fencing between the side building wall line and the street and behind the front building wall line is limited to 6 feet high.

Rear and Side Yard Height: Required rear-yard and interior side-yard fencing behind the front building wall is limited to 8 feet high.

Sight Triangle Rule: Fence heights within the sight triangle are subject to Sec. 27-290.

Corner-Lot Visual Clearance Area: Except in zoning districts where no front yard setback is required, corner lots require a visual clearance area where nothing may be erected, placed, planted, parked, or allowed to grow more than 3 feet higher than the curb level, measured from the top of the curb.

No-Curb Measurement: Where there is no curb, the visual clearance limit is 3 feet higher than the center line grade of adjacent streets.

Sight Triangle Dimensions: The visual clearance area applies within 25 feet of the intersection of the street lines.

MATERIAL AND CONSTRUCTION LIMITS

Allowed Residential Fence Materials: Residential fences must be constructed of wood, chain-link, PVC/resin, stone or masonry materials, or ornamental metals only.

Wood Fence Materials: Wood fences must use traditionally accepted residential fence materials.

Prohibited Materials: Residential fences may not be constructed from railroad ties, tires, nontraditional fence materials, rubble, or salvage materials.

Finished Side: A fence running parallel to a public street right-of-way must have the finished side facing outside the lot toward the public street.

Electric Fences: Electric fences are prohibited under Sec. 14-227.

Barbed Wire: A fence constructed in whole or in part of barbed wire is prohibited unless the barbed wire is located 6 feet or more above ground level at the base of the fence. Residential fence height, material, and sight-triangle limits still apply.

Fence and Wall Maintenance: Fences and walls must be maintained in an upright position and in good condition.

PRIVATE RESTRICTIONS

Private restrictions operate independently from City of Norfolk fence rules. These may include HOA covenants, subdivision restrictions, deed restrictions, private easements, agricultural agreements, boundary agreements, or recorded plat conditions.

Private restrictions may be more restrictive than city rules. The city materials do not state that the City of Norfolk enforces private covenants or private agreements as part of ordinary residential fence administration.

Material Compliance: Residential fences must use the materials allowed by Sec. 27-288 and must not use prohibited nontraditional, rubble, salvage, railroad-tie, or tire materials.

Street-Facing Orientation: Fences parallel to the public street right-of-way must have the finished side facing outside the lot toward the public street.

Barbed Wire and Electric Fence Restrictions: Electric fences are prohibited, and barbed wire is restricted under Sec. 14-227.
